Acceptance of Terms
These Website Terms of Use (“Terms”) govern your access to and use of websites, subdomains, landing pages and online services operated by Alatorre Law, P.C. (“Alatorre Law,” “we,” “us” or “our”), including alatorre.law and crash.alatorre.law (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Informational Purposes Only
The Site provides general information and is not legal advice. Laws and legal outcomes depend on specific facts and may change. You should not act or refrain from acting based solely on Site content. Contact a qualified attorney for advice about your circumstances.
No Attorney-Client Relationship
Viewing the Site, submitting a form, sending a message, downloading a guide, scheduling a consultation or communicating with the firm does not create an attorney-client relationship. An attorney-client relationship exists only after the firm completes any necessary review and conflicts analysis and both the firm and client enter into a written engagement agreement.
Do not send time-sensitive or highly confidential information unless the firm has agreed to receive it. We take reasonable steps to protect submitted information, but an unsolicited communication does not by itself create attorney-client duties or prevent the firm from representing another person, subject to applicable professional obligations.
No Guarantee; Prior Results
Case descriptions, testimonials, reviews, awards, recoveries and prior results do not guarantee or predict a similar outcome. Each matter depends on its own facts, law, evidence, parties, insurance, venue and other circumstances. “Millions Recovered for Injured Clients” describes aggregate past recoveries and is not a promise about any future matter.
Case Evaluations and Fees
A request for a free case evaluation does not obligate the firm to accept a matter. We may decline a matter for any lawful reason. Fee arrangements and costs, if any, are governed only by a written engagement agreement. Statements such as “no fee unless we recover” apply only when included in the executed agreement and may not include all costs or circumstances; review the agreement carefully.
Communications and Call Recording
If you submit contact information, we may respond by telephone, text message or email consistent with your consent and our Privacy Policy. Calls may be recorded or transcribed for quality assurance, training, intake, recordkeeping and dispute-resolution purposes after an audible notice. Text-message participation is also governed by our SMS Terms.
Permitted Use
You may use the Site only for lawful, personal and informational purposes. You may not:
- Attempt to gain unauthorized access to the Site, accounts, systems or data.
- Interfere with security, availability or operation of the Site.
- Use automated means to scrape, copy or harvest Site content or personal information except as permitted by law and our written authorization.
- Submit false, misleading, unlawful, threatening or malicious content, or impersonate another person.
- Use the Site to transmit malware, spam or other harmful code or communications.
Intellectual Property
The Site and its content—including text, graphics, logos, photographs, videos, downloads, design and software—are owned by Alatorre Law or used with permission and are protected by intellectual-property laws. You may view and print reasonable portions for personal, noncommercial use. No other license is granted. You may not reproduce, distribute, modify, publicly display or create derivative works without prior written permission or another lawful basis.
Third-Party Services and Links
The Site may use or link to third-party services, including scheduling, video, mapping, analytics, advertising, call-tracking and communication providers. We do not control third-party services and are not responsible for their availability, content, security or privacy practices. Your use of them may be governed by separate terms and policies.
Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation. We do not warrant that the Site will be secure, current, complete or free of harmful components. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Alatorre Law and its attorneys, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the Site. This limitation does not apply where prohibited by law and does not limit duties arising from an attorney-client relationship established by a written engagement agreement.
Governing Law and Venue
These Terms are governed by Arizona law, without regard to conflict-of-law principles. To the extent a dispute relating to the Site may be brought in court, the parties consent to the exclusive jurisdiction and venue of the state or federal courts located in Pima County, Arizona, except where applicable law requires another forum.
Changes
We may revise these Terms from time to time. The revised Terms will be posted with a new effective date and apply prospectively from that date. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
Severability and Waiver
If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to do so later.
