What Are The Consequences Of Conviction?
Arizona doesn’t mess around when it comes to driving under the influence. Even if it’s your first time being pulled over while drunk driving, and even if you didn’t hit anyone else’s car or damage any property, and even if your blood alcohol concentration (BAC) was below the legal limit of .08 at the time you got pulled over (but you were accused of showing signs of impairment), you may still have to contend with the following repercussions:
- License suspension for 90 days or more
- Jail time for 10 days or more
- Fines of $1,250 or more
- Undergoing alcohol screening, education, and/or treatment
- Installing a certified ignition interlock device in your vehicle (at your expense)
- Mandatory community service
- And more.
For a second or other repeat offense, the penalties increase to license suspension for 12 months or more, jail time for 90 days or more, fines of $3,000 or more, along with the other penalties.
For an extreme DUI (if you were found with a BAC of 0.15 or higher), or for an aggravated DUI (if you had a suspended, revoked, or canceled license, or if this was your third DUI in 84 months, or if you had a person under 15 in the vehicle with you at the time you were pulled over, or if you refused to submit a BAC test while you had an ignition interlock device), the penalties of fines, jail time, and license suspension continue to increase.
If you did cause an accident that led to someone’s injury or to their death, you could obviously be facing much stronger charges that carry much stricter punishments.
But the legal outcome has ramifications for other areas of your life as well. You will likely lose your job, and have difficulty finding future employment opportunities – your career dreams may be derailed. You may be evicted from your current living situation, or be unable to make your rent or mortgage payments; you may go into debt because of the fines. You might lose custody rights. Your clean record and reputation will be ruined. If you’re not a citizen yet, your immigration status could be jeopardized. Our Marana DUI lawyer can explain what you are up against and will strive to get your charges dismissed or reduced!
Do I Have Any Defense?
Making a mistake shouldn’t have to destroy your life, and the good news is that it may not have to if you have good legal representation! Javier Alatorre, our lead Marana DUI lawyer, is extremely familiar with all of the nuances of Arizona DUI laws and with the local Marana court system. He has spent over 17 years fighting for the rights of the accused! He can listen to your story, investigate your arrest, and determine if your traffic stop was even legal – if not, your case may stop right there! He can also determine if the field sobriety or chemical test was conducted correctly, can look to poke other holes in the prosecution’s case, and can build a solid defense that will give you a much better chance at winning than you would have on your own or with a public defender.

Marana, AZ Practice Areas
I was accused/cited for DUI so I hired Javier Alatorre to defend me (I was under the legal BAC limit). When I first spoke to Javier, he treated me like a person and never made me like a criminal so I felt very comfortable with him. He was always available to discuss this case even though it dragged on for over 3 years (COVID). The end result was that he got my cased dismissed. I couldn't ask for anything better. I highly recommend Javier.
